Oracle sends force majeure notice on its New Mexico Stargate site
A gas pipeline to Project Jupiter slipped by nearly six months after permit denials, and Oracle says the campus is still on its planned schedule.
Oracle has sent a force majeure notice to Blue Owl Capital over Project Jupiter, the 2.45-gigawatt Stargate data centre campus in New Mexico. Bloomberg had the story first and TechCrunch wrote it up on Thursday, reporting that the notice would let Oracle delay payments if the site misses its 2028 target.
The trigger is power. An Energy Transfer gas pipeline meant to fuel the site slipped by nearly six months, to 1 February 2027, after repeated permit denials, according to TechCrunch. An air-quality permit for the fuel cell system is still pending, with a state decision due by 23 November.
Oracle said Project Jupiter remains on its planned schedule and that the company is fully committed to New Mexico. TechCrunch reported that the notice is not an exit, and that it protects Oracle from payment obligations should the construction run late.
Stargate is the data centre programme Oracle runs with OpenAI and SoftBank, and Oracle is the main tenant at Jupiter. Blue Owl Capital is the developer and Bloom Energy supplies the fuel cells. Oracle did not put a figure on what a delay could cost, and TechCrunch reported none.
